1. Acceptance of Terms

By accessing or using Apply U's services, you enter into a legally binding agreement with Apply U UK ("Apply U", "we", "us" or "our") and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of another person or organisation, you confirm that you have authority to bind them to these Terms. If you do not agree to these Terms, you must not use the Service.

2. Eligibility and Age Requirements

You may use the Service only if you are legally capable of forming a binding contract with Apply U and are not barred from using the Service under applicable law. The Service is intended for individuals who are at least 18 years old. If you are under 18 years old, you may only use the Service with the consent and ongoing supervision of a parent or legal guardian, who will be responsible for your use of the Service.

3. Description of Service

Apply U is an AI-powered platform that assists students with planning, preparing and tracking their university applications. Our core services currently include, but are not limited to:

  • CV and resume building tools with AI-powered suggestions
  • Personal statement writing assistance and feedback
  • University program recommendations and guidance
  • AI-powered document review and improvement suggestions
  • Application deadline management and tracking tools

We may add, modify or remove features from time to time in order to improve the Service or reflect legal or technical developments. Where we make material changes, we will act reasonably and, where required, provide notice in advance as described in Section 15 (Changes to Terms).

4. User Accounts

When you create an account with us, you must provide information that is accurate, complete and current at all times. You are responsible for all activity that takes place under your account and for maintaining the confidentiality of your login details.

You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account so that we can help you secure it.

5. Acceptable Use

You may use our Service for lawful purposes only and in a manner that is consistent with applicable laws, the rules of any educational institution and these Terms. You agree not to use the Service:

Prohibited Activities:

  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate against any person or group
  • To submit false or misleading information in applications or documents, including fabricated grades, achievements or credentials
  • To violate or infringe the rights of others, including intellectual property, privacy or publicity rights
  • To send unsolicited or unauthorised advertising, promotional materials, spam or junk mail
  • To attempt to gain unauthorised access to any portion of the Service or any other systems or networks
  • For any unlawful, fraudulent or harmful activity, including scams, money laundering or other criminal conduct
  • To upload highly sensitive personal information (such as passport numbers, national ID numbers or full payment card details) unless strictly necessary and you have permission to share it
  • To carry out automated scraping, bulk requests or other automated access that interferes with or overloads the Service
  • To copy, decompile, reverse engineer or otherwise attempt to derive the source code, underlying models or know-how of the Service, except where such restrictions are not permitted by law

6. Academic Integrity

You acknowledge that you are solely responsible for the content of any application materials that you submit to educational institutions. You agree not to use the Service to engage in any form of plagiarism, cheating or other conduct that violates the academic integrity or conduct policies of any institution, including submitting AI-generated or AI-assisted content as your own original work where this is not permitted.

Apply U does not endorse or condone any misuse of the Service for dishonest or fraudulent purposes. You remain solely responsible for ensuring that your use of the Service complies with the rules of each institution and for any consequences arising from your applications.

7. Intellectual Property Rights

The Service and its original content, features, software, models and functionality are and will remain the exclusive property of Apply U UK and its licensors. The Service is protected by copyright, trademark and other laws, and you may not reproduce, distribute or create derivative works from the Service except as expressly permitted by these Terms.

You retain all rights to any content you submit, upload or otherwise make available through the Service ("User Content"). You grant Apply U UK a worldwide, non-exclusive, royalty-free licence to host, store, use, reproduce, modify, adapt and display your User Content as necessary to (i) operate and provide the Service to you and other users and (ii) maintain and improve the Service, including for quality assurance and analytics, in accordance with our Privacy Policy. We will not publicly disclose your personal application materials (such as your CV or personal statement) in identifiable form without your explicit consent. We do not permanently store the original source files that you upload, and we do not use your personal information or identifiable application materials to train our own models. We may use anonymised or aggregated data generated through your use of the Service to analyse and improve the accuracy and performance of our algorithms.

8. Privacy and Data Protection

Your privacy is important to us. Apply U UK acts as the controller of your personal data processed through the Service. In general, we collect and use your account information and any application-related information you choose to provide in order to operate the Service, support you and improve our products. Our servers and primary data storage are located within the United Kingdom and the European Economic Area, and we work only with trusted providers who implement appropriate security measures. For information about what personal data we collect, how we use and share it, the legal bases we rely on, how long we keep it, any international transfers and your rights (including rights of access, correction, deletion and data portability), as well as how to complain or contact our data protection contact, please see our Privacy Policy, which forms part of these Terms.

9. Payment Terms

Some features of our Service are provided on a paid subscription basis. Where you purchase a subscription, you agree to pay the fees and any applicable taxes shown to you at checkout. Subscriptions are billed in advance on a recurring basis (for example, monthly or annually, as selected by you) until cancelled in accordance with this Section.

You may cancel your subscription at any time through your account settings or by contacting us using the details below. Cancellation will take effect at the end of your current billing period, and you will continue to have access to paid features until that time. After cancellation, you will not be charged for future billing periods.

Refunds are provided in accordance with our refund policy and applicable consumer laws. If you are a consumer resident in the United Kingdom or the European Economic Area, you may have a legal right to cancel your initial subscription within 14 days of first purchase (the "cooling-off" period). If you exercise this right after we have started providing the Service at your request, we may deduct from any refund an amount that is proportionate to the Service that has already been provided. To request a refund or exercise your cancellation rights, please contact us by email using the address in the Contact Information section.

We do not store your full payment card details on our systems. Payments are processed securely by trusted third-party payment providers, who act in accordance with their own terms and privacy policies. We may share limited information with these providers as necessary to process your payments, prevent fraud and handle billing issues.

10. Disclaimers and No Professional Advice

The Service and all content (including any AI-generated suggestions) are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Apply U excludes all representations, warranties, conditions and terms, whether express, implied or statutory, including any implied warranties of accuracy, merchantability, fitness for a particular purpose or non-infringement.

Apply U does not guarantee admission to any university or educational institution. Our services are designed to assist and improve your application materials, but admission decisions remain solely with the respective institutions.

Any guidance, recommendations or suggestions provided by the Service, including AI-generated content, are for informational and educational purposes only and do not constitute legal, immigration, professional educational counselling, financial or other professional advice. You should not rely on the Service as a substitute for independent professional judgment, and you remain responsible for any decisions you make.

11. Limitation of Liability

Subject to the paragraph below, in no event shall Apply U UK, nor its directors, employees, partners, agents, suppliers or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, use, goodwill or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service.

Nothing in these Terms shall limit or exclude any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence and for fraud or fraudulent misrepresentation.

To the maximum extent permitted by law, and subject to the paragraph above, the total aggregate liability of Apply U UK to you arising out of or in connection with the Service or these Terms shall not exceed the total amount you have paid to us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim. If you use the Service free of charge, our aggregate liability to you shall be limited to one hundred pounds sterling (£100).

12. Termination

We may suspend or terminate your account or access to the Service (in whole or in part) if you materially or repeatedly breach these Terms, misuse the Service, or where we are required to do so by law or a competent authority. Where reasonable and practicable, we will provide you with advance notice of termination, but we may act immediately and without notice in serious cases (for example, fraud, abuse or security risks).

Upon termination, your right to use the Service will cease immediately and we may delete or disable access to your account. Fees already paid are non-refundable except where required by law or expressly stated otherwise in these Terms. If we terminate your account due to your serious breach of these Terms, you will not be entitled to any refund for the remaining portion of your subscription period.

Before closing your account, you are responsible for exporting or copying any application materials or other content you wish to keep. Following termination, we may retain certain limited information for a period reasonably necessary to comply with our legal, accounting or anti-fraud obligations, after which it will be deleted or anonymised in accordance with our Privacy Policy.

13. Third-Party Services

Some features of the Service rely on or integrate with services provided by third parties, such as cloud hosting providers, AI model providers and payment processors. Your use of such third-party services may be subject to their own terms and privacy policies. While we take reasonable care in selecting our providers, we are not responsible for any unavailability, errors or losses caused solely by such third-party services.

14. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

If you are a consumer resident in the United Kingdom or the European Union, you may also benefit from mandatory consumer protection laws in your country of residence, and nothing in these Terms affects those rights. If you have a complaint, please contact us first using the details below. You may also have the right to bring claims before your local courts or consumer protection authority.

15. Changes to Terms

We may update these Terms from time to time, for example to reflect changes to our Service or legal requirements. If we make material changes, we will provide you with reasonable advance notice (for example by email, in-app notification or by posting a notice on our website) at least 30 days before the new Terms take effect, unless a shorter period is required by law. The updated Terms will apply from the effective date stated in the notice. If you do not agree to the updated Terms, you should stop using the Service and, if you have a subscription, cancel it before the new Terms take effect. Your continued use of the Service after the effective date will constitute your acceptance of the updated Terms.
